These General Terms and Conditions of Sale (GTC) govern all product sales made on the Wello Beauty website. Any order placed on our site implies the full and unreserved acceptance of these GTC by the customer.
1. Presentation of Wello Beauty
Wello Beauty is a premium cosmetics and skincare brand, offering skincare products designed to reveal the skin's natural radiance, with a commitment to elegance, softness, and quality standards.
2. Purpose
The purpose of these GTC is to define the rights and obligations of the parties in connection with the online sale of products offered by Wello Beauty to any consumer or professional customer making a purchase on our site.
3. Products
The products offered for sale are those listed on the site on the day of consultation by the customer, within the limits of available stock. Wello Beauty strives to present the essential characteristics of its products with the greatest precision, including their composition, content, and instructions for use.
4. Prices
Product prices are indicated inclusive of all taxes (TTC), excluding delivery fees, which are specified before the final validation of the order. Wello Beauty reserves the right to modify its prices at any time, it being understood that the applicable price is that in effect at the time of order validation.
5. Availability
Our product offers are valid within the limits of available stock. In the event of a product being unavailable after an order has been placed, the customer will be informed as soon as possible and may choose between a full refund of their order or its replacement with an equivalent product.
6. Orders
Any order placed on the site implies the customer's full adherence to these GTC. The ordering process includes selecting products, checking the cart, entering delivery and billing information, and then payment. An order confirmation is sent by e-mail upon payment validation.
7. Payments
Payment for orders is made online, using the payment methods offered on the site (credit card, and if applicable PayPal or any other method available via Shopify Payments). The debit is made at the time of order validation.
8. Payment Security
Bank transactions are secured by certified providers (Shopify Payments, Stripe, PayPal), ensuring the encryption and protection of transmitted banking data. Wello Beauty never has access to its customers' complete banking data.
9. Delivery
Products are delivered to the address indicated by the customer during the order. The customer is responsible for verifying the accuracy of the delivery information provided. Any error in the address details releases Wello Beauty from its responsibility in the event of impossible delivery.
10. Delivery Times
Processing and delivery times are specified in our Shipping Policy. These times are indicative and may vary depending on the destination and the carrier responsible for shipment.
11. Delays
In the event of a significant delivery delay, the customer may contact our customer service to obtain information on the status of their order. A delivery delay does not automatically entitle the customer to compensation, except in cases of an unreasonably long delay attributable to Wello Beauty.
12. Taxes and Customs
For international deliveries outside the European Union (or outside the applicable duty-free zone), customs duties and local taxes may be required upon receipt of the package. These charges are the sole responsibility of the customer and are not the responsibility of Wello Beauty.
13. Package Receipt
The customer is invited to check the condition of their package upon receipt and to report any anomaly (damaged, opened, or incomplete package) as soon as possible to our customer service, with photographs if possible.
14. Right of Withdrawal
In accordance with applicable regulations, the customer has a period of 14 calendar days from the receipt of their order to exercise their right of withdrawal, without having to provide any reason. This period applies subject to the legal exceptions provided for unsealed cosmetic products, detailed below.
15. Return Conditions
To be accepted, returns must comply with the following conditions:
- Product unopened, unsealed, and unused
- Original packaging intact
- Return made within 14 days of receipt
- Proof of purchase included (order number)
16. Exceptions related to cosmetic products
For reasons of hygiene and health protection, unsealed, opened, or products whose protective film has been removed cannot be returned or refunded, in accordance with the legal exceptions provided for the right of withdrawal concerning sealed goods that cannot be returned for reasons of health protection or hygiene.
17. Legal Guarantee
Wello Beauty guarantees its products against any lack of conformity and hidden defects, in accordance with applicable legal provisions. This guarantee does not cover damages resulting from improper use of the product, inconsistent with the provided usage instructions.
18. Liability
Wello Beauty cannot be held responsible for the non-performance of the contract in the event of stock shortage, force majeure, disruption or total or partial strike of postal services and transport means, or in the event of improper use of the products by the customer, particularly in the event of an allergic reaction linked to an unnotified individual sensitivity.
19. Force Majeure
Wello Beauty cannot be held liable for any delay or non-performance resulting from an event of force majeure as usually recognized by case law, including natural disasters, strikes, fires, computer or telecommunications failures beyond our control.
20. Intellectual Property
All elements of the Wello Beauty website (texts, visuals, logos, brands, formulas, packaging) are protected by intellectual property law and remain the exclusive property of Wello Beauty. Any unauthorized reproduction, representation, or exploitation is strictly prohibited.
21. Modification of the GTC
Wello Beauty reserves the right to modify these GTC at any time. The applicable GTC are those in force on the date the order is placed by the customer.
22. Applicable Law
These GTC are subject to the legislation applicable at Wello Beauty's place of establishment. Any dispute relating to their interpretation or execution falls under the jurisdiction of the competent courts, unless there is a mandatory provision to the contrary protecting the consumer.
